The Court of Protection often has to grapple with the most intimate aspects of a person’s private and family life. Sometimes the focus is on whether P has the capacity to make decisions about sex or personal relationships. Sometimes its whether a proposed course of action would break the criminal law. Finding the right outcome can be a difficult process and require sensitivity and humanity, as well as intellectual clarity.
