21 January 2021 Webinar: Domestic Violence & the Immigration System

Our Lucy Mair will be presenting this pre-recorded webinar on ‘Domestic violence and the immigration system – navigating the routes & remedies’ hosted by MBL.

This pre-recorded webinar will be streamed at 12:30pm on Thursday 21st January 2021 and will remain available to view by delegates who have registered by then for 90 days.

Introduction

The UK has long recognised the necessity of providing some form of leave to remain for those who enter the UK as foreign national partners/spouses but whose relationships break down as a result of domestic violence.

While the immigration rules provide a route to settlement under DV-ILR, many of those applications are refused and the Home Office no longer provides a right of appeal in such cases.

This new webinar will examine existing routes for victims of domestic violence and remedies for those whose applications fail.

What You Will Learn

This webinar will cover the following:

  • The eligibility and criteria for those applying for leave to remain under the destitution domestic violence (DDV) concession
  • The eligibility and criteria for those applying for ILR under DV-ILR
  • Common reasons for these applications to fail
  • Best practices in building successful applications, legal submissions and evidence;
  • The merits of and strategic approach to the various remedies including administrative review, judicial review and statutory appeals
  • The case of MY (refusal of human rights claim) Pakistan [2020] and its implications for challenging DV-ILR refusals
