From 1st October 2011, Section 53 of the Borders, Citizenship and Immigration Act 2009 comes into force opening up the possibility of the transfer of judicial review proceedings to the Tribunal. This seminar will update delegates on the latest developments in immigration and asylum law with an emphasis on these changes in respect of judicial review of and to the Upper Tribunal, both in terms of procedure and relevant caselaw. The seminar will also cover recent key decisions of the appellate and european courts, which provide scope to challenge the decisions of the UKBA and the tribunal. This will include developments in fresh claims, Zambrano and Article 8 in light of ZH Tanzania and s.55 of the Borders Act.

Session 1: The Upper Tribunal

  • Challenges to decisions by the Upper Tribunal post-Cart and PR (Sri Lanka) & Ors v Secretary of State for the Home Department [2011] EWCA Civ 988).
  • Practical guidance for practitioners in respect of claims for judicial review being transferred to the Upper Tribunal.

Session 2: Case law update

This session will focus on a number of key recent decisions, and will analyse how these decisions can assist practitioners challenge the decisions of the authorities. Cases will include:

  • BN, R (on the application of) v SSHD [2011] EWHC 2367 (admin) - Fresh claims and Article 8.
  • AA v UK (ECHR) - Deportation and Article 8.

This seminar is aimed at an intermediate / advanced level of practitioner.
