Crime seminar : civil liberties and Human rights arguments

The seminar will cover three papers:

(1) Article 6 (Right to fair trial): is it possible to receive a fair hearing in delayed cases / historical prosecutions? A consideration of the Article 6 arguments from recent historical abuse cases (Anver Sheikh and Tony Burke) and their applicability to other areas – Article 6, right to fair trial, and Hearsay - presented by Mark Barlow

(2) The use of human rights arguments as criminal defences, as challenges to some sentences, and to challenge decisions not to prosecute. Article 8, right to privacy, and the case of Keith Rose (an “act outraging public decency”); Article 10 and Article 11 in defences for protest and charges of conspiracy to demonstrate. Article 5 arguments in the challenge to IPP sentences. Article 2 arguments where state agents are responsible for death, and prosecutions for corporate manslaughter; – presented by Pete Weatherby

(3) Terrorism offences: defending charges brought under the Terrorism Act 2000, particularly s57 (Possession for terrorist purposes) and s58 (Collection of information) – Farrhat Arshad

This seminar will be covered in a practical way to cater for all levels of experience. There will be opportunity at the end for questions and answers.
