This seminar will look at a range of practical issues and recent developments in relation to litigation involving persons lacking capacity.

Overview

This seminar will look at a range of practical issues and recent developments in relation to litigation involving persons lacking capacity. Topics to be covered include:

  • What ‘capacity’ means?
  • Procedural issues in the civil courts
  • Getting the right medical evidence
  • Dealing with Litigation Friends and the Official Solicitor
  • Making applications to the Court of Protection

In addition there will be specific break-out sessions dealing with particular issues arising from housing, community care, immigration and prison law.

GCN are pleased to announce that Dr Tor Pettit will present a sesison on 'Getting the right medical evidence'.

Any solicitors or advisers acting for individuals in civil litigation, whether in the County Court or High Court.
