Sheffield Council loses appeal in third party race discrimination case
In a judgment handed down earlier this month (14/6/11), the EAT has held that Sheffield City Council was liable under the Race Relations Act 1976 (RRA) for harassment carried out by a third party to one of their employees.
Sheffield City Council v Norouzi UKEAT/0497/10, President
Norouzi was a social worker employed in a home for troubled children. The EAT dismissed the appeal brought by Sheffield City Council and held that the employer was liable for racial harassment and racial discrimination on the basis that it had not done enough to protect the Claimant from harassment and discrimination by one of the children.
Norouzi was represented by Kerry Smith of GCN.
