House of Lords gives leave to appeal in Income Support / asylum case.

Kola and Mirzajani v Secretary of State for Work and Pensions [2004] EWCA Civ 638.
The House of Lords has given leave to appeal in this case, which is likely to be heard by the House of Lords next year.

This is a social security case concerning the application of Regulation 70(3A) of the Income Support (General) Regulations 1987 however the main issue of the appeal is whether asylum seekers should be bound by the conduct of the agents who assist them to enter the UK illegally with a view to claimng asylum.
Paul Draycott has been representing the two Appellants from the Social Security Appeal Tribunal hearings onwards.
