Appeal considers Education Act 2002 statutory guidance on unfair dismissal

The EAT case of Jackson v Wigan Metropolitan Council [2007] and another has been considered in The All England Law Reports this week.

Jackson v Wigan Metropolitan Council [2007] All ER (D) 328 (May).

This was the first appeal case we are aware of to consider the status of the Education Act 2002's statutory guidance upon an unfair dismissal claim. The appeal was allowed in part and found the tribunal had been in error in failing to make a decision on the issue of the statutory guidance in the instant case. For that reason the tribunal was invited to consider the implication of the guidance on a controlled remission.
