The EAT heard the Council's appeal (together with the Claimants' appeals against the Tribunal's findings on pay protection) on 13th - 16th September 2010. Judgment is awaited.

Following a six-week hearing, the Council’s claims that male manual workers were paid more because of a genuine material factor (GMF) other than their sex were rejected, paving the way for the Claimants to receive significant sums by way of back pay.
The claimants were represented by Kate Stone of GCN (and leading counsel Brian Napier QC).
