Garden Court North Chambers barrister Pete Weatherby was interviewed yesterday on BBC Radio Manchester about a Rochdale man with TB forcibly detained at North Manchester General Hospital.
The Rochdale man is in an infectious disease unit after Rochdale Council obtained a court order to detain him as an in-patient. The man is reportedly being detained under sections 37 and 38 of the Public Health Act (Control of Disease) 1984.
BBC Radio Manchester news covered this news story and asked Pete Weatherby to explain the law around detaining people for treatment against their will, and to comment on whether, under human rights law, this detention could be challenged.
