The Court of Appeal has this week given judgment in three test cases of men found guilty of killing their wives. Pete Weatherby was interviewed for BBC Radio Manchester yesterday to explain when a "loss of control" defence could be raised and also whether the qualifying trigger could be sexual infedelity.
Pete Weatherby clarified that the Court of Appeal ruling this week said that sexual infedelity can be considered as part of the general context when running defence arguments of "loss of control". He also gave an explanation of how the partial defence to murder of "loss of control" has replaced the partial defence of provocation (also known as "a crime of passion").
