IPP sentences to be considered by House of Lords next week

Pete Weatherby will appear in the House of Lords next week in the IPP cases of R (Brett James and others) v Secretary of State for Justice.

Three cases are to be heard together before House of Lords on 27th January 2009 and are listed for 3 days.

  • Secretary of State for Justice (Respondent) v James (appellant) (Formerly Walker and another)
  • R (on the application of Lee) v Secretary of State for Justice
  • R (on the application of Wells) v Secretary of State for Justice

This is the first opportunity their Lordships have had to consider some of the issues arising from the imposition of IPP sentences. It will examine a number of issues of wider public importance relating to the concept of arbitrary detention and Article 5 of the ECHR.
