Right to silence? Pete Weatherby explains
27/09/2006
Garden Court North Chambers barrister Pete Weatherby was interviewed this morning on BBC Radio Manchester about a European Court of Human Rights decision on motorists' right to silence, due to be made in Court today.
The European Court of Human Rights has accepted eight motorists' applications claiming that S172 of the 1988 Road Traffic Act breaches the right to silence implicit in Article 6 of the European Convention on Human Rights.
Human Rights group Liberty is backing two motorists who claim requiring car owners to reveal who was driving a vehicle caught speeding on camera is a breach of their right to silence.
BBC Radio Manchester news are covering this story and asked Pete Weatherby to comment, in his capacity as a Human Rights law expert, on the likely prospects of this case, how the ECHR will go about making their decision and the wider context of bringing legal challenges in the ECHR.
