The article provides an update on the recall provisions as they stand and the effect of the amended provisions in practice. It explains how the CJIA 2008 created a single scheme that applies to offenders regardless of the scheme under which they were sentenced, and discusses eligibility for the two forms, fixed-term recall (FTR) and standard-term recall (STR). Whether recall will be under either section 254 or 255 of the CJIA 2008 is also considered, along with how to legally challenge decisions (including judicial review and oral hearings before the Parole Board).
