Prisoners with learning disabilities

In this month's Inside Time (August 2011), GCN's Matthew Stanbury and Marcus Farrar of Chivers Solicitors consider the difficulties faced by prisoners with learning disabilities, evaluate the limited provisions currently available and look at the potential of Learning Disability Unit referrals.
The article includes reference to the provisions in PSI 32/2011 Ensuring Equality, which is a response to the Equality Act 2010, but highlights that " those with learning disablities may not realise that they have a disability at all...". The cases of three post-tariff lifers with learning disablities are considered, on which all three judicial reviews were conceded by the Secretary of State on the basis of failure to make reasonable adjustments.
The article also draws attention to the potential for referral to Learning Disability Units under guidance published on 1st April 2011 entitled âThe Transfer and Remission of Adult Prisoners under s47 and s48 of the Mental Health Actâ.
