Mark Barlow acknowledged in Rook & Ward on Sexual Offences (4th ed.)

In the latest edition of Rook & Ward on Sexual Offences (published 15th December 2010) Mark Barlow has been acknowledged in the Preface for his contribution to a new specialist chapter on Historic Cases. The new chapter also includes reference to a number of key cases in which Mark has appeared and quotes from an recent article by Mark on the Challenges of Historic Allegations.

Rook & Ward is a practical and accessible work on sexual offences, with detailed coverage of both offences and procedure. It has a strong practitioner focus and includes detailed guidance on how to deal with problems encountered in practice.

In the Preface, the editors acknowledge Mark Barlow for his contribution:

"...We are grateful to Mark Barlow...for reading our Chapter 26 and for [his] constructive suggestions."

Chapter 26 is a new specialist chapter on Historic Cases which deals with problems that are commonly encountered in the prosecution of past sexual abuse. In this chapter, the authors quote from a recent article by Mark Barlow and Mark Newby The Challenges of Historic Allegations of Past Sexual Abuse (16.02.2009) :

“Whilst attitudes to and awareness of sexual abuse have significantly changed over the last decade, the ‘conspiracy of silence’ of family sexual abuse has been a long standing feature within the law, with many abusers maintaining dominance over their victims for years, ‘secrets’ being taken to the grave. But this position should not be used as a vehicle to deny those accused the fundamental right to a fair hearing. This is a difficult issue and the law struggles to maintain these two but conflicting needs of protecting the accused whilst bringing justice for the abused.”
