Latest developments in employment law, including the new laws on Age Discrimination (13/07/2006)
This seminar, presented by Paul Draycott and Kery Smith , covered:
(1) Age discrimination: effect of the 2006 regulations, Mangold and the EC Framework Employment Directive 2000/78
The new laws on age discrimination will come in to force in October 2006 making discrimination on the basis of age unlawful in employment (unless objectively justified). The ECJ's decision in Mangold [2006] IRLR 143 says that member states are required to provide protection against age discrimination prior to the relevant implementation date. Therefore, age discrimination arguments can be run now and a representative may act improperly if they do not do so. Paul Draycott provideed practical guidance on the effect of these new regulations, with reference to the appropriate legal precedents and frameworks.
(2) Recent developments in the law relating to Unfair Dismissal (including s 98a ERA 1996).
(3) An update on the law concerning statutory dispute resolution procedures.
